Valuation Services for Overseas Clients

Foreign authorities, government agencies, financial institutions and other organisations may require an independent valuation of a property located in Malaysia. Where the property is situated in Malaysia, a valuation by a Malaysian registered valuer can provide an independent assessment of its Market Value based on Malaysian property market evidence, title particulars, planning controls, tenure, land use and other relevant local factors.

Such valuation services are commonly required by individuals residing overseas, including in Singapore, Australia and the United States of America, who own property or have an interest in property in Malaysia.

There are various circumstances in which a Malaysian valuation report may be required.

Singapore – Housing & Development Board (HDB)

For an HDB applicant, ownership or an interest in property outside Singapore may be relevant to HDB’s assessment of eligibility. HDB’s rules may take into consideration both local and overseas property interests, depending on the particular housing scheme and circumstances of the applicant.

Subject to the applicable rules and the applicant’s circumstances:

An applicant may be required not to own or have an interest in certain local or overseas private residential properties; or

In certain resale situations, an applicant who owns an overseas private residential property may be required to dispose of the property within the prescribed period.

Therefore, where a person residing in Singapore owns a Malaysian property such as a house, condominium, apartment, land or other real property, information concerning the property’s value may be required as part of the relevant assessment or submission.

A Malaysian valuation report provides an independent assessment of the property’s Market Value, rather than relying solely on the owner’s estimate or the property’s historical purchase price.

Apart from HDB-related matters, valuation reports for Malaysian properties may also be required for:

  • Intended sale and purchase;
  • Estate and probate matters;
  • Distribution of inherited assets;
  • Divorce or matrimonial asset settlement;
  • Litigation and court proceedings;
  • Financing and refinancing;
  • Taxation and reporting purposes; and
  • Other legal, financial or administrative requirements.

Australia

For Malaysian property owners residing in Australia, the purpose of a valuation may differ depending on the relevant authority, transaction or financial requirement.

For example, a valuation of Malaysian property may be required in connection with:

Immigration or visa-related financial documentation;

Australian taxation or capital gains tax matters;

Estate or asset-related matters;

Financial reporting or disclosure requirements; and

Sale, transfer or other disposal of Malaysian property.

Where the property is situated in Malaysia, a Malaysian registered valuer is generally well placed to assess its Market Value because the valuation requires consideration of Malaysian-specific information, including:

Recent Malaysian property transactions and market evidence;

Malaysian land title and ownership particulars;

Tenure and restrictions in interest;

Local planning and zoning controls;

Permitted land use and development potential;

Location-specific market conditions; and

Other relevant Malaysian legal and property factors.

An overseas valuer may not have access to the same depth of local market evidence or the necessary knowledge of Malaysian property and planning matters. Engaging a Malaysian registered valuer therefore provides a valuation based on local Malaysian market evidence and professional knowledge.

Why Is a Valuation Required Instead of Using the Original Purchase Price?

An original purchase price does not necessarily represent the property’s current Market Value or its value at a particular historical date.

For example, a Malaysian property may have been purchased in 2005 for RM500,000, while its current Market Value may be RM1,200,000. If an authority needs to establish the value of the asset today, the original purchase price would not provide an indication of its current worth.

An independent valuation can establish the Market Value as at a specified valuation date, supported by relevant market evidence.

Inherited Property and Retrospective Valuation

The issue can be particularly important where a property has been inherited.

For example, a Malaysian property may have been inherited from a deceased parent in 2003, with the transfer taking place without monetary consideration. In such circumstances, there may be no meaningful purchase price that can be used as the property’s acquisition value.

Where the relevant authority or tax legislation requires the property’s value as at the date of inheritance or another historical date, a retrospective valuation may be undertaken to determine the property’s Market Value as at that specified date.

The retrospective Market Value may then be used as a reference point for purposes such as determining the property’s acquisition value and estimating any subsequent gain arising from its disposal, subject to the applicable tax rules and requirements.

Frequently Asked Questions

  1. Why do I need a Malaysian valuation report if I live overseas?

A Malaysian valuation report provides an independent assessment of the Market Value of a property located in Malaysia. It may be required by government authorities, financial institutions, tax authorities, courts or other organisations for various purposes.

  1. Can a Malaysian registered valuer value my property if I live in Singapore, Australia or the United States?

Yes. You do not need to be physically present in Malaysia for a valuation to be undertaken, although the valuer may require relevant property documents and access to the property where necessary.

  1. Can I use the original purchase price instead of a valuation?

Not necessarily. The original purchase price may not reflect the property’s current Market Value or its value at a particular historical date. An independent valuation can establish the Market Value as at the required valuation date.

  1. Can you provide a retrospective valuation for an inherited property?

Yes. A retrospective valuation can determine the property’s Market Value as at a specified historical date, subject to the availability of sufficient property information and relevant market evidence.

  1. What documents are usually required for a Malaysian property valuation?

Depending on the purpose of the valuation, documents may include the title, sale and purchase agreement, property details, assessment or quit rent records, approved plans and other relevant documents. We will advise you on the documents required for your particular case.
